This defendant was indicted for murder in the second degree for the killing of Walter Morris, his son-in-law. The jury returned a verdict finding defendant guilty of manslaughter in the first degree, and fixing as the punishment three years’ imprisonment in the penitentiary.
The first asserted error to be noted is the action of the trial court in overruling defendant’s motion to quash the indictment.
