hThe State filed a bill of information, charging the defendant-appellant, Mr. Sahara Clay, with two counts of violating La. R.S. 14:34 relative to aggravated battery. The defendant entered not guilty pleas at his arraignment. A preliminary hearing was held; the trial court found probable cause to bind the defendant over for trial. After the defendant waived his right to a jury trial, a bench trial was held. At the conclusion of testimony, the court found the defendant guilty of La. R.S. 14:34.1, second degree battery, as to both counts. The court sentenced the defendant…
