STRUCKMEYER, Justice.

Appellant, Alce Benny Coward, . was charged with murdering one Patsy Antone. He entered a plea of not guilty and, after a trial, the jury returned a verdict of murder in the second degree. From the conviction and sentence, he appeals. Judgment affirmed.

Appellant asserts first a double proposition to the effect that it was error for the trial court to fail to direct a verdict in his favor on the charge of murder in the first degree, and that it was error for the court to permit the jury to return a verdict of murder in the second degree.
