This is a habeas corpus proceeding instituted by appellant, Nathan Carouthers, against the appellees to recover possession of his minor child, Elvy Carouthers. The respondents, Dowdell and wife, are the father and mother of Pearl Carouthers, the deceased mother of the minor, Elvy, and wife of appellant. Mrs. Ca-routhers died at the home of her parents in Liberty county. She and her husband went from their home in Hardin county to visit her parents on August 10, 1912, and she was taken sick the day after they reached appel-lees’ home and continued sick with typhoid fever until her death…
