This civil action was originally commenced on April 5, 1994 in the Circuit Court of Berkeley County, West Virginia. The plaintiff, Robert L. Booth, alleged that the defendants breached his employment contract by demanding his resignation and that the actions of the defendants amounted to retaliatory discharge and the tort of outrage.
