STATEMENT OF THE CASE

This is an appeal by defendant-appellant Malcolm Borgman (Malcolm) from an adverse judgment in the Decatur Circuit Court in favor of plaintiff-appellee Patricia Borgman (Patricia), awarding Patricia the proceeds of a life insurance policy on the life of her husband, Gene Borgman (Gene), who was the son of Malcolm Borgman. This is the second appeal in this case. The first appeal was from a summary judgment in favor of Patricia.
