MEMORANDUM AND ORDER

HARPER, District Judge.

Petitioner has filed a motion under 28 U.S.C.A. § 2255 asking the court to set aside and vacate his conviction and order a new trial. After the filing of the original petition the petitioner filed an amended petition setting up additional allegations.

This is the fourth 2255 motion filed by this petitioner. He was originally charged in four counts for violation of the Federal narcotic laws, was tried to the court and found guilty, was sentenced to ten years on each of four counts, Counts 1 and 2 to run concurrent, Counts 3 and 4 to run concurrent,…
