The State of Louisiana, through the Department of Highways, acting under the authority of LSA-R.S. 48:441-48:460 (Act 107 of 1954), expropriated certain property with improvements belonging to the defendant, John McDuffie, by ex parte procedure on January 30, 1957 after depositing $46,650, estimated to be just compensation for the property taken, into the registry of the court for the benefit of the persons entitled thereto.
