This is an appeal from the district court’s denial of the motion of the appellant guardian ad litem, attorney William P. Neubauer, for an order requiring the appellee, Box Butte County, to pay attorney fees he incurred in defending himself in an action instituted against him and others in the U.S. District Court for the District of Colorado by Denise E. Marsh, formerly Denise E. Wacker, the petitioner-appellee mother, in this dissolution action between her and the respondent-appellee father, Timothy A. Wacker.
