MEMORANDUM

REGAN, District Judge.

Petitioner, convicted of murder in the first degree upon trial to a jury in the Circuit Court of St. Louis County, Missouri, *140was sentenced on January 5, 1973, to life imprisonment. The conviction was affirmed by the Supreme Court of Missouri in State v. Nelson, 514 S.W.2d 581 (1974). A motion for post-conviction relief under Missouri Supreme Court Rule 27.26 was denied, and that order was affirmed by the Missouri Court of Appeals, St. Louis District, on May 25, 1976. (Nelson v.
