Per Curiam:.

Respondent, Harold J. Macomber, appeals as of right from Kent County Probate Court child protective proceedings concerning his daughter, who was born December 8, 1970. We reverse.

We first address the issue of whether the juvenile division of the probate court had jurisdiction over the Macomber child. A petition must be filed before the juvenile division of the probate court can assume jurisdiction.
