On July 20, 1903, William Dodson, the plaintiff below, an employe of the J. W. Bishop Company, the plaintiff in error in this court, while carrying two pails of cement across a walkway consisting of 2 planks 10 indies wide, placed for the purpose between two parallel piers about 13-⅛ feet apart, fell to the ground below, a distance of 2o or 30 feet. He was seriously and permanently injured. He brought suit against the J. W. Bishop Company, and by the verdict of the jury was awarded $3,200.
