RYDER, Judge.
Krajenta seeks review of Emergency Rule 38 FER 79-4, which was promul*1201gated by the Division of Workers’ Compensation on August 1,1979, and became effective on that same date. We agree with petitioner’s contention that the rule was not adopted in accordance with the requirements of Section 120.54(9)(a), Fla.Stat. (Supp.1978). Therefore, we grant the petition and declare the rule invalid.
