This action was brought to recover the value of certain property destroyed while in transit from Chicago to Eew York under contracts made by Frederick H. Cullom, the plaintiff’s agent and assignor, with the Wabash Western Eailway Company, the defendant’s predecessor.
The complaint sets forth four causes of action, but the third and fourth are not now important, since the plaintiff submitted to a voluntary nonsuit as to them. The other two were to recover the value of (1) certain samples belonging to the plaintiff, and (2) of Cullom’s personal effects.
