This is an appeal from a judgment of conviction of murder in the first degree entered upon a jury verdict and from an order denying a new trial. The defendant received a sentence of life imprisonment.

The information charged the defendant with the murder of one Margaret Seyler. It was filed in Madison County where *254the alleged crime occurred. The trial was held in the bordering County of Beaverhead.
