OPINION AND ORDER
JUSTO ARENAS, United States Chief Magistrate Judge.
The matter before me is cross-plaintiff Rubén Blades’ cross-motion for summary judgment against Robert Morgalo filed July 13, 2010. (Docket No. 234.) The cross-plaintiff seeks summary judgment as to the first cause of action in his amended claim. For the reasons set forth below, cross-plaintiffs motion is DENIED.
