In August, 1928, the plaintiff was visiting her aunt, who lived next to a public playground owned and maintained by the city of Buffalo. While lawfully on her aunt’s property/ she was hit in the head by an object which was hurled through the air. She claims that the missile which struck her was a baseball, which was being used by two boys who were playing “ catch ” on the adjoining playground, and which was thrown wild by the pitcher.
