Upon this appeal a question is raised which if resolved in favor of the defendants is decisive of all the issues in the case. While a number of matters are *49properly discussed in the briefs, we shall only state such facts as are necessary to present what appears to us to be the primary question, the determination of which, in any view of the case, is necessarily involved.
