In this memorandum opinion, the court considers the motion for summary judgment (Doc. No. 14) filed by plaintiffs ERBE Elektromedizin GmbH and ERBE Medical UK Limited (collectively “plaintiffs” or “ERBE”), as well as plaintiffs’ motion to dismiss (Doc. No. 15) the counterclaim asserted by defendant, Jerome Canady, M.D. (“defendant” or “Canady”) against ERBE.
