Error from District Court, Kay County; Wm. M. Bowles, Judge. \Frank B. Rogers was convicted of manslaughter in the first degree, and brings error.

The plaintiff in error in this case, who will be referred to as defendant, was convicted in the district court of Kay county of manslaughter in the first degree, and sentenced to four years in the penitentiary. The defendant, on February 28, 1910, shot one Ed Conrad, inflicting two wounds from which Conrad died on March 2, 1910. Defendant, Rogers, was subsequently tried and convicted, and appealed to this court; that judgment was reversed and the cause remanded for a new trial. Frank B. Rogers v. State, 8 Okla.
