Before this court are third party plaintiff's motion to disqualify counsel for third party defendant and third party defendant’s motion to dismiss. The underlying claim in this case alleges violations of the Securities Exchange Act of 1934 by Fort Deposit Bank, the defendant, and third party plaintiff.
