New York Court of Appeals

Decided February 5, 1915PublishedCited by 15 opinions

Appeal from a judgment of the Supreme Court, rendered February 27, 1914, at a Trial Term for the county of Cattaraugus, upon a verdict convicting the defendant of the crime of murder in the first degree. The facts, so far as material, are stated in the opinion. The statements of a person charged with crime are by no means conclusive, and undue weight should not be given them, for innocent men sometimes lie in order to divert suspicion from themselves.
