On the 18th day of October, 1884, before John A. Allen, a justice of the peace of Adams county, Thomas J. Petty, as principal, and James M. Petty, as surety, entered into a recognizance to the People of the State of Illinois, in the sum •of $1000, conditioned as follows:

“The condition of this recognizance is such, that if the above bounden Thomas J. Petty shall personally be and ■appear before the criminal court of the said county of Adams •on the first day of the next term thereof, to be holden in the •court house in Quincy, on the third Monday of January, A.
