Andrew Philip Legare was tried and convicted in Baldwin County Superior Court on charges of armed robbery, burglary and malice murder; he was sentenced to life for the armed robbery, 20 years for the burglary and death for the murder. The convictions and sentences were affirmed by this court. Legare v. State, 243 Ga. 744 (257 SE2d 247), cert. denied, 444 U. S. 984 (1979). Legare then brought a petition for habeas corpus in the Superior Court of Butts County.
