GRAVES, Presiding Judge.

Appellant was charged with the offense of murder with malice in that he took the life of Clara Russell by shooting her with a shotgun. His punishment was assessed at confinement in the state penitentiary for a term of 20 years.

The offense is alleged to have been committed on June 19, 1952.

A motion to quash the indictment because of race discrimination in the organization and selection of the grand jury that returned the indictment was presented to the court. It appears that some evidence was introduced upon the motion, when it was suggested by the trial court and…
