Plaintiff bank, as executor of the estate of Christopher C. Gaard, deceased, and Mayme Tangen Gaard, his surviving spouse, brought these actions to recover the' proceeds of certain life insurance policies and annuities payable upon the death of the deceased. The funds in controversy, in the sum of $27,599.89, were paid into court by the insurance companies, and the actions proceeded against Genevieve Ellen Gaard Pepper, daughter of the deceased by a former marriage, the beneficiary named in the policies. The cases were consolidated for trial and appeal.
