Appeal from Perry Probate Court; tbe Register in Chancery presiding, pro hac vice, on account of the incompetency of the Probate Judge. This was a motion made by R. L. Steele, tbe appellant, to quash certain executions issued out of the Probate Court of Perry County. On July 15, 1865, said Steele became one of the sureties on the bond of W. B. Modawell as administrator of the estate of R. H. Hudson.

In one aspect, this case is in precisely the same condition as the case of E. A. Steele et al. v. Graves, 68 Ala. 17. Following that decision, the judgment of the Probate Court is reversed, and here rendered, correcting the executions, by striking from them the name of Robert L. Steele as one of the defendants.
