This controversy originates in an auto-pedestrian accident which occurred at about 10:30 A.M. on July 6, .1959, in Colorado Springs at the intersection of Colorado .and Cascade Avenues, Colorado Avenue running east ■and west and Cascade Avenue extending north and south. The pedestrian, Margaret Freeland, was in the act of crossing Colorado Avenue immediately west of its intersection with Cascade Avenue.
