CAIRES, Associate Justice.—

This is presented asan agreed case. Appellant filed a petition in the District Court of the Forty-eighth Judicial District of Tarrant County against Rush Loyd and others in an action of trespass to try title, and demanded of appellee, as clerk of that court, that he should issue citation to defendants returnable to a term of the court alleged to begin on the second Monday in May, 1892. The clerk refused to make the citation returnable as requested, and this suit was brought to compel him to do so. An alternatiim writ of mandamus was issued, but upon final hearing…
