Appeal from a judgment of the Supreme Court (Harris, J.), entered May 21, 1992 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of respondent terminating his employment.

Petitioner commenced employment with respondent on October 1, 1987 as a resident inspector responsible for inspecting the quality of construction work performed under contracts with respondent and for compliance with the contract specifi*728cations.
