Tommie Lee Neeley was charged by affidavit with committing bodily injury upon a police officer. 1 He entered his plea of not guilty and waived a trial by jury. The trial court found Tommie Lee Neeley guilty of the offense and sentenced him to . . the custody of the Department of Corrections, for a period of not less than one year nor more than five years, . . .” Neeley’s defense counsel had filed a motion for special findings and conclusions prior to trial and had filed the same motion prior to sentencing.
