BROOKS, Judge.

Appellant was convicted of assault to murder and his punishment assessed at confinement in the penitentiary for five years.

The facts in this ease show, in substance, that appellant owned a farm in Jack County and had rented the same or part thereof to Will Camp and his wife, the injured parties. One Sunday night after 12 o’clock, while Camp and his wife were sleeping in their bed, some one from a window shot into the room, wounding both Camp and his wife.
