The within action arises from the premature birth of twin girls to plaintiff Mary Somoza. The only issue on this appeal is the liability of defendant Dr. Dorothy Gutwein, a resident physician at defendant St. Vincent’s Hospital and Medical Center of New York, and vicariously through her, the hospital itself.
