People Ex Rel. Goznelli v. Brantley

Illinois Supreme Court

1Opinion of the CourtChief Justice Underwood

This is an appeal from the judgment of the Randolph County circuit court, which dismissed the petition of Anthony M. Goznelli for a writ of habeas corpus. Relator is imprisoned pursuant to a 1970 forgery conviction in Champaign County, and here argues that the indictment to which he pleaded guilty was void, and hence the court was without jurisdiction to sentence him. While the State contends that, except in cases of extradition and child custody, this court should disclaim jurisdiction in habeas corpus appeals, that issue was resolved to the contrary by People v. Lawrence, 48 Ill.2d 368, 369.
