— In an action to recover on a promissory note, the defendants appeal from (1) an order of the Supreme Court, Nassau County (Burke, J.), entered June 25, 1987, which granted a motion by the plaintiff for summary judgment pursuant to CPLR 3213 in lieu of a complaint, and (2) a judgment of the same court, dated July 13, 1987, which is in favor of the plaintiff and against them in the sum of $41,208.50.
Ordered that the appeal from the order is dismissed; and it is further,
Ordered that the judgment is affirmed; and it is further,
Ordered that the plaintiff is awarded one bill of costs.
