This is an action upon a note and mortgage executed by Laura Parks, in-

dividually, and as trustee and independent executrix of the estate of O. F. Parks, deceased, in which it is sought to foreclose a mortgage on certain lands in Creek county.

At the trial the parties entered into a stipulation to the effect that the premises involved were the'property of O. F. Parks at the time of his death on January 24. 1911; that O. F. Parks was a resident of the state of Texas, and that his last will and testament was admitted to probate in Dallas county, Tex., and letters testamentary were issued to…
