The plaintiff, as liquidator of the Lumbermen’s Mutual Accident Com*913pany, sued the defendant to recover the sum of $2,217.04, representing the total of rebates or dividends paid by order of the board of directors to the defendant, as a policy holder, during the years 1905, 1906, and 1907. Plaintiff alleged that the defendant was a mere trustee for its insured workmen, who paid the premiums, and had no legal right to receive rebates or dividends from the company.
