Defendant appeals from a judgment imposing a suspended sentence upon his conviction by a jury of abandonment by a supporting spouse in violation of G.S. § 14-322(b). He assigns error to the trial court’s denial of his motion to dismiss at the close of the State’s evidence and at the close of all the evidence. At trial, the evidence *699tended to establish that in July of 1993 defendant married Kelly Clark Talbot, the prosecuting witness.
