L. I. Bennett and M. S. Bennett doing business under the trade-name of

K. M. A. Fuel Oil Company, sued J. J. Holcomb and Otto Elder in the Thirtieth district court of Wichita county to recover the sum of $890.49, alleged to be due them for fuel oil sold and delivered to the defendants.

At the time of filing suit, they sued out a writ of attachment upon the ground that defendants were about to dispose of their property with the intent to defraud their creditors.
