This is an appeal from a judgment of non-suit rendered by the District Court.

A preliminary motion to dismiss the appeal because the appeal bond is defective was made, and will be first considered.

*664It has heen argued as if the facts had been made to appear judicially to the court. The defect alleged is that the bond was not signed by the appellant but by his attorneys-at-law.-' I am of opinion that this fact does not appear.
