The instant matter comes before this court as an adversary proceeding brought by plaintiff Corporate Financing, Inc. (alternatively referred to as “plaintiff” or “debtor”) seeking a declaration that certain notes and related mortgages are property of its bankruptcy estate pursuant to 11 U.S.C. § 541(a) and that plaintiff is entitled to the proceeds from some of those mortgages which are now being held in escrow.
