KLEINSCHMIDT, Judge.

Appellant Kenneth Allen Clark, was charged with two counts of aggravated assault, first-degree burglary, attempted armed robbery and misconduct involving a weapon. The burglary charge was dismissed. After trial to a jury, appellant was found guilty of the four remaining counts. The aggravated assaults and attempted armed robbery were found to be dangerous offenses by the jury. Appellant moved for new trial, on the basis that the state failed to properly serve subpoenas for witnesses requested by the defense. His motion was denied after an evidentiary hearing.
