OPINION OF THE COURT AND ACTION ON PETITION FOR EXTRAORDINARY RELIEF IN THE NATURE OF A WRIT OF CORAM NOBIS

KERN, Senior Judge:

This is a petition for extraordinary relief in the nature of a writ of coram nobis. See 28 U.S.C. § 1651(a) (2006). Petitioner, whose direct appeal is final and is now facing deportation, alleges that he received ineffective assistance of counsel when his trial defense counsel failed to inform him that he could be deported if he pleaded guilty.
