The Court has before it the motion [114] of Lowry Development, LLC (Lowry) for partial summary judgment and the motion [129] of Great American Insurance Company of New York (Great American) for summary judgment in these consolidated cases. Great American and Lowry seek a definitive ruling whether a builders risk policy issued by Great American covers wind damage the insured property sustained during Hurricane Katrina.
