In an action to recover damages for breach of contract and fraud, the plaintiffs appeal, as limited by their brief, from (1) so much of an order of the Supreme Court, Suffolk County (Molia, J.), dated July 20, 2007, as denied their motion pursuant to CPLR 3025 (b) for leave to amend the complaint to add Celano Construction Corp. as a party defendant, granted that branch of the defendants’ cross motion which was, in effect, pursuant to CPLR 3211 (a) (5) to dismiss the complaint insofar as asserted against the defendant PC.
