(After stating the foregoing facts.)
1. The evidence for the plaintiff tended to support the allegations of the petition. Therefore, this court having ruled that the petition set out a cause of action against Eidson and Daniel as well as against Maddox, there is no merit in the contention of Eidson and Daniel that the evidence did not authorize a verdict in favor of the plaintiff against them as joint tort-feasors with Maddox, but required a finding that the proximate cause of the death of the plaintiff’s husband was the negligence of Maddox, and that no alleged negligence of the driver of the…
