NICKELL, JUDGE:

Consequences attach when a probationer violates conditions of release. This Opinion confirms the role of the Commonwealth’s Attorney in a court-initiated hearing when a probated- defendant fails to comply with the terms of release.

As the appellant, the Commonwealth argues it is a. critical player in the probation modification1 process — to protect the rights of victims, to champion the interests of all Kentuckians, and to ensure probation violators receive due process.
