This case is brought by appeal from the Appellate Court for the First District. The opinion of that court, by Adams, P. J., is as follows:

“This is an appeal from the judgment rendered in an action of debt on a judgment. The declaration is in the usual form in such cases, and alleges that at the July term, 1871, of the superior court of Cook county the plaintiff (appellee) recovered a judgment against the defendant (appellant) for the sum of $833.35 damages and costs, the costs amounting to $5.75; that the record of the said .judgment was destroyed by fire in October, 1871, and was not in…
