delivered the opinion of the Court:
Appellant and appellee were candidates for assessor of Harter township, in Clay county, at the annual spring election, April 2, 1889. The election officers returned that appellee, Moses T. Israel, received for said office 290 votes, and that appellant received for the same office 291 votes, and was duly elected assessor of said township.
