Affirming.

In a trial in tlie Jefferson circuit court the defendant, John Baker, a colored man, was convicted of the murder of his wife, Maria Baker, and his punishment fixed at death.

The facts are: Defendant and deceased were married about three years before the tragedy. At the latter date he was 38 years of age, strong and robust. She was about 21 ¡or 22 years of age, quite small and rather delicate.
